Photo booth rental terms & conditions
The below terms and conditions are agreed upon by default by both the client renting a photo booth or any related equipment from Smartbooth Photobooths and Smartbooth Photobooths who rents the photo booth and any related equipment to the client. The client by default agrees to, and must adhere to, the below terms & conditions upon the acceptance of a quote for the photo booth rental service provided by Smartbooth Photobooths or any of its partners.
Smartbooth Photobooths requires written acceptance of the quotation prepared for any services including photo booth rental services along with a 50% deposit before the event date can be confirmed. The remaining 50% is payable at least 7 days before the actual date of the event. Failure to make the outstanding payment will result in the cancellation of the booking and the deposit may be forfeited.
In the event of a cancellation, a written cancellation should be sent to Smartbooth Photobooths no less than 14 days in advance which will result in a full refund to you, the client. Should a cancellation be made in less than 14 days in advance, your deposit may be forfeited.
Additional photo booth time requested at the event is charged at an hourly rate and should be paid in cash before the operation of the photo booth can continue.
Smartbooth Photobooths commits to a working photo booth for at least 80% of the event time including occasional maintenance time. Should Smartbooth Photobooths not be able to provide a working photo booth for at least 80% of the time due to additional maintenance or unforeseen circumstances, we will stay longer at the event to make up for the lost time free of charge. In the unlikely event that the photo booth is completely non-operational, you the client will be refunded a pro-rata rate for services not rendered depending on the circumstances.
In the unlikely event that the printer does not print the photos, we will print all the photos after the event, prepare them and ship them to you free of charge.
Event and particular changes
Any event details received on initial inquiry using any means of communication will be considered final and correct. In any instance of event particular changes or corrections, Smarbooth Photobooths will be under no obligation to accommodate said changes. All event particular changes should be submitted in writing to Smartbooth Photobooths at least 7 days prior to the new event date or original event date if the event date does not change. Should the event details be submitted less than 7 days in advance of the event date, the event may be cancelled and the deposit will be forfeited at the discretion of Smartbooth Photobooths.
Termination of service
Hostile or abusive behavior, both physically or verbally, against any of the Smartbooth Photobooths staff and/or the Smartbooth Photobooths equipment both directly or indirectly by you, your guests, or anyone associated with your event will under no circumstances be tolerated be neither Smartbooth Photobooths, it’s staff or any of its partners or associates. In the event of hostile or abusive behavior towards any of the aforementioned entities both directly and indirectly, the onsite Smartbooth Photobooths staff will attempt to resolve the matter with the you as the event owner or the event organiser.
During the photo booth rental period, Smartbooth Photobooths reserves the right to terminate the service immediately as and when deemed necessary whether it be before or after attempting to resolve the matter with the event owner or organizer.
Smartbooth Photobooths also reserves the right to immediately terminate the service if, at any time, the Smartbooth Photobooths staff feel that they themselves or the photo booth equipment is in danger both directly or indirectly in any way whatsoever.
The termination of the service under any of the aforementioned circumstances will result in immediate evacuation from the event premises and no refund will be made to the client.
The client agrees that they shall be fully responsible for any damage or loss to Smartbooth Photobooths equipment, props or consumables due to the misuse of the Smartbooth Photobooths equipment. The client shall solely be responsible for any costs incurred for the repair or replacement of any damaged equipment, props or consumables due to the misuse of the equipment, props or consumables owned by Smartbooth Photobooths or any of its partners or associates.
In the event where Smartbooth Photobooths cannot attend an event due to unforeseen circumstances such as, but not limited to, traffic jams, harsh weather conditions, illness or death, accidents, vehicle breakdowns or the malfunction of equipment, Smartbooth Photobooths can not be held liable. In the unlikely event that any of these conditions hold true, the client will be refunded any monies paid for services not rendered.
Smartbooth Photobooths will be indemnified against all liability relating to the clients event both during and after the clients event. Smartbooth Photobooths will be indemnified from the start of the service into the future against any and all liability relating to the client, the guests, the event, third party suppliers as well as any other factors remotely associated to any of the aforementioned entities.
All media taken by any device, equipment, application, software or any related process or items which is either directly or indirectly owned, operated or associated by or with Smartbooth Photobooths will remain the sole property of Smartbooth Photobooths. Media owned by Smartbooth Photobooths includes all media taken of you, your guests or any part of your event before, during and after the event. Smartbooth Photobooths reserves the right to use and distribute any media they own in any way they deem fit including, but not limited to, uploading to social media, advertising material, promotional material and content generation in any space or area both privately and publicly, locally and internationally.
Promotions & Discounts
Promotions and discounts will be applied to the photo booth rental price only unless explicitly specified otherwise in the terms and conditions of the promotion and/or offer. All additional costs including, but not limited to, traveling costs, value added services and custom branding will be billed separately and a discount will not be applied unless explicitly stated otherwise in the terms and conditions of the promotion and/or offer.
In order to fully qualify for a discount, promotion or offer, the discounted/promotional quote needs to be accepted and the standard deposit paid in order to secure a booking BEFORE the official end date of said promotion, discount or offer. No discounts will be applied to quotes which are accepted after a promotion or offer has ended even if said discounted quote has been prepared during the the period of the promotion. Any discount, as a standard, expires along with the end date on a quote unless otherwise agreed upon with a Smartbooth Photobooth representative.
All promotion end dates will always be included in any standard Smartbooth Photobooth promotional content and communications including, but not limited to, social media, email and online content.
